1. Assumption of Inherent Risks

I voluntarily apply to participate in dog training activities offered by Balanced Canine of Arizona, LLC. I understand that handling, observing, and training dogs involves inherent risks of personal injury, illness, permanent disability, death, and property damage.

These risks include, but are not limited to:

  • Bites, scratches, punctures, or impacts from dogs (including my own dog or other participants' dogs).

  • Tripping, falling, or collisions caused by leashes, training barriers, equipment, or uneven outdoor/indoor turf and surfaces.

  • Unpredictable behavioral reactions of animals to sights, sounds, scents, sudden movements, or environmental conditions.

  • Facility and weather conditions, including ambient heat, uneven terrain, or natural outdoor elements.

I knowingly, freely, and voluntarily assume all such risks, both known and unknown, even if arising from the negligence of the Released Parties identified below, and assume full personal responsibility for my participation.

2. Comprehensive Release of Liability

In consideration of being permitted to participate in classes and enter the training grounds, I, on behalf of myself, my heirs, executors, administrators, assigns, and personal representatives, HEREBY FULLY RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS:

(collectively referred to as the "Released Parties") from any and all claims, demands, losses, suits, liabilities, or expenses (including reasonable legal fees and medical costs) for bodily injury, personal injury, illness, disability, death, or property damage arising out of, related to, or occurring during my participation in training sessions or while on the facility premises, whether caused by the ordinary negligence of the Released Parties or otherwise.

3. Arizona Strict Statutory Liability & Indemnification

  • A.R.S. § 11-1025 Acknowledgment: Pursuant to Arizona Revised Statutes § 11-1025, I acknowledge that the owner of a dog is strictly liable for damages suffered by any person bitten by the dog, regardless of whether the dog has a prior history of viciousness or the owner had prior knowledge.

  • Owner Indemnification: I agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, damages, liabilities, costs, and expenses (including attorney's fees) brought by any third party arising out of, resulting from, or caused by the acts, bites, or behavior of my dog during, immediately before, or immediately after training activities.

  • Primary Insurance: I warrant that I maintain personal liability coverage (via homeowners, renters, or specialty pet liability insurance) that will serve as the primary recovery source for any third-party damage or injury caused by my dog.

4. Training Directives & Instructor Authority

  • 4-Foot Buffer: I agree to maintain a minimum physical distance of 4-feet between my dog and all other dogs and handlers at all times unless directly commanded otherwise by the instructor.

  • Leash Control: My dog will remain secured on a standard, flat 4-to-6-foot fixed leash unless directly commanded otherwise by the instructor. Retractable leashes are strictly prohibited.

  • Dismissal Authority: The instructor retains full professional discretion to dismiss any dog or handler from class immediately, without refund, if safety is compromised.

5. Vaccination & Health Warranty:

The participant certifies and warrants that the enrolled dog is in good physical health, free of infectious or contagious diseases (including, but not limited to, canine cough, parvovirus, and parasites), and is current on all core veterinary vaccinations as recommended by their veterinarian, including Rabies (as required by Arizona state law), DHPP/DA2PP (Distemper, Hepatitis/Adenovirus, Parvovirus, Parainfluenza), and Bordetella.
